What To Do if Accused of Domestic Abuse

Being accused of domestic abuse can feel overwhelming, but with the right legal support, many cases can be resolved quickly, quietly, and with no criminal record. A signiicant number of domestic allegations in Scotland are based on misunderstandings, exaggerated claims, or incidents taken out of context — and with early intervention, we are often able to persuade the Procurator Fiscal not to proceed.

Our Glasgow-based Domestic Abuse lawyers defend clients all over Scotland with one clear goal:
If possible, stop the case before it ever reaches court!

1. Do Not Contact the Complainer

Avoid any direct contact unless advised otherwise as you could make the siutaion worse. By staying compliant, we can make stronger arguments for the case to be dropped.

2. Get a Lawyer Immediately

Early representation is often the difference between a case progressing and being discontinued. We act fast to protect your position.

3. Keep the Situation Private

Do not speak to anyone else about the case. We handle all communication and protect you from misunderstandings being used as evidence.

4. Secure Any Helpful Evidence

Screenshots, emails, text messages, CCTV, and call logs can often be enough to undermine the allegation entirely. Some of these you can obtain, others we can obtain on your behalf.

5. Let Us Deal With the Police

Clients can easily and inadvertently damage their case by speaking to the police, who are highly trained in soliciting information which may be used against you. Our domestic abuse lawyers can speak directly to officers and also the Procurator Fiscal to challenge weak evidence and push for the case to be dropped.
